Terms and Conditions of Use
This legal notice (hereinafter called "Legal Notice")
regulates the use of the following Internet websites: www.valentinadeandrade.com.br,
www.valentinadeandrade.com.ar and www.valentinadeandrade.com
("THE WEBSITE") as well as the contents thereof that
the Civil Association LINEAMIENTO UNIVERSAL SUPERIOR ("L.U.S."),
a non-profit organization, makes available to Internet Users.
1. LEGAL NOTICE AND ACCEPTANCE
The mere use of the SITE by somebody conferres him/her the
condition of “User” and implies the full acceptance
of the terms and conditions included in this Legal Notice as
soon as the User logs in the Site and that is published herein
by the L.U.S. association. It is hereby stated that there are
3 (three) versions of this Legal Notice, namely: Spanish, English
and Portuguese. It has to be expressly understood that the only
valid version in legal terms is the one stated in Spanish. Therefore,
in the event of any interpretative disagreement, those provisions
stated in the Spanish text of the Legal Notice will prevail
over the ones stated in any other version. In the same way,
as the contents of the Website are translated into 3 (three)
languages, namely: Spanish, English and Portuguese, and being
the original text and valid version the one written in Portuguese,
it is implied that, in the event of any interpretative disagreement,
those provisions in the Portuguese text are the ones that will
prevail over the ones included in any other version.
2. PURPOSE
Through its WEBSITE, the non-profit association L.U.S. puts
its Database (hereinafter "the Contents") at the Users´
disposal enabling them to access to information.
3. USER´S OBLIGATIONS
The User agrees to use the WEBSITE and the Contents, texts,
photographs, graphics, images, icons, technology, software,
links or any other audiovisual or sound Contents, graphic design
and source codes in accordance with the law and this Legal Notice
and in the understanding that this list is not limited.In accordance
to this, the User agrees to abstain from any use of the Contents
with illegal purpose or action as forbidden hereunder in the
Legal Terms, or take any actions with harmful effects to third
party’s rights or interests.
4. INTELLECTUAL PROPERTY
All the information contained in the WEBSITE, including texts,
graphics, images, logos, articles, videos, animations, digital
and audio clips, photographs, illustrations, icons and the compilation
of the contents of the WEBSITE among other things, including
the trademarks “VALENTINA DE ANDRADE” and “LINEAMIENTO
UNIVERSAL SUPERIOR” are the property of L.U.S. and are
protected by the Argentine laws as well as by international
treaties.Moreover, it is hereby expressly stated that the books
written by VALENTINA DE ANDRADE are also property of L.U.S.
as the Association owns the copywrite according to the law 11.723.
The Contents of the Website can not be copied, reproduced, re-edited,
displayed, loaded, transmitted or otherwise distributed –neither
paid nor free- without a previous written allowance extended
by L.U.S.
5. EXCLUSION OF WARRANTIES AND RESPONSIBILITIES
5.1. Exclusion of warranties and responsibilities related to
the operation of the WEBSITE
5.1.1. Availability, continuity, usefulness and fallibility
L.U.S. does not guarantee the availability and continuity of
THE WEBSITE OPERATION AND, WITHIN THE FULL EXTENT AS LEGALLY
PERMITTED, IS NOT LEGALLY RESPONSIBLE FOR ANY DAMAGE OR LOSS
THAT MAY OCCUR AS CONSEQUENCE OF LACK OF AVAILABILITY OR CONTINUITY
OF THE WEBSITE, FOR ANY INFRINGEMENT TO THE WEBSITE´S
USEFULNESS THAT USERS MAY ARGUE, FOR THE WEBSITE´S OPERATION
FALLIBILITY AND, PARTICULARLY THOUGH NOT EXCLUSIVELY, FOR ANY
FAILURE PREVENTING USERS FROM LOGGING IN THE WEB PAGES OF THE
SITE.
5.1.2. Privacy and Security when using the WEBSITE
and its Contents
L.U.S. does not guarantee privacy and security when using the
WEBSITE and its Contents and, particularly, does not guarantee
that an unauthorized third party could have access to information
about the type, conditions, features and circumstances under
which Users utilize the WEBSITE and Website’s Contents.
WITHIN THE FULL EXTENT AS LEGALLY PERMITTED, L.U.S. WILL NOT
BE LIABLE FOR ANY KIND OF DAMAGES THAT MAY OCCUR AS A CONSEQUENCE
OF ANY UNAUTHORIZED THIRD PARTY´S KNOWLEDGE ABOUT THE
TYPE, CONDITIONS, FEATURES AND CIRCUMSTANCES UNDER WHICH USERS
UTILIZE THE WEBSITE AND WEBSITE´S CONTENTS.
5.2. Exclusion of warranties and responsibilities of
the Contents
5.2.1. Contents usefulnessL.U.S does not guarantee the utility
that the User may expect from the Contents.
In this sense, AND WITHIN THE FULL EXTENT AS LEGALLY PERMITTED,
L.U.S. IS NOT RESPONSIBLE FOR ANY KIND OF DAMAGE THAT COULD
HAVE BEEN EXPERIENCED, AS A CONSEQUENCE OF ANY TRANSMISSION,
DIFFUSION, STORAGE, AVAILABILITY PROCEDURES, RECEPTION, ACHIEVEMENT
OR ACCESS TO THE CONTENTS OF THE SITE.
5.2.2. Thoroughness and updating L.U.S. does not guarantee
thoroughness or updating of the Website Contents.
ACCORDING TO THIS, AND AS PERMITTED BY THE LAW, L.U.S. WILL
NOT BE RESPONSIBLE FOR ANY KIND OF DAMAGE THAT MAY OCCUR AS
A CONSEQUENCE OF LACK OF THOROUGHNESS OR UPDATING OF THE WEBSITE.
5.3. Exclusion of warranties and responsibilities for
the use of the WEBSITE and its Contents by the User.
L.U.S. is not obliged to check, and will not check, any use
of the WEBSITE and Website’s Contents made by its Users.
In addition, L.U.S. does not guarantee that Users will utilize
the WEBSITE and Website’s Contents in conformity with
the Legal Notice. L.U.S. does not guarantee that Users will
utilize the WEBSITE and Website’s Contents on a careful
and reasonable way. Moreover, L.U.S. is not obliged to check
User’s identity as well as the truthfulness, validity,
thoroughness and/or authenticity of the data as supplied by
Users to other Users about themselves.
L.U.S. IS NOT LEGALLY RESPONSIBLE FOR ANY KIND OF DAMAGE THAT
MAY OCCUR AS A CONSEQUENCE OF THE UTILIZATION OF THE WEBSITE
AND ITS CONTENTS BY THE USER OR AS A RESULT OF THE LACK OF TRUTHFULNESS,
VALIDITY, THOROUGHNESS AND/OR AUTHENTICITY OF THE INFORMATION
SUPPLIED BY USERS TO OTHER USERS ABOUT THEMSELVES AND, PARTICULARLY
BUT NOT EXCLUSIVELY, FOR ANY KIND OF DAMAGE THAT MAY OCCUR AS
A CONSEQUENCE OF A THIRD PARTY´S IMPERSONATION CARRIED
OUT BY A USER IN ANY SORT OF COMMUNICATION THROUGH THE WEBSITE.
6. DURATION AND TERMINATION OF THE WEBSITE
The WEBSITE and its Contents will provisionally have an unlimited
duration. Nevertheless, L.U.S. might terminate or suspend the
WEBSITE and/or its Contents supply at any time if necessary.
7. APPLICABLE LAW AND JURISDICTION
This Legal Notice complies and is under the Argentine laws.
L.U.S. and the User will be submitted under the Argentina law
and Buenos Aires courts, and they resign herewith to any other
court or jurisdiction as well.
